1Acceptance of Terms
Any order accepted by the Company, whether or not it is based on or results from a price list or quotation given by us, is deemed to incorporate these Terms. No variation, modification or substitution of these Terms is binding unless specifically accepted by the Company in writing.
By placing an order or otherwise transacting with us, you ("the Purchaser") acknowledge and agree to these Terms. Your agreement takes effect from the earlier of:
- the moment your order payment is confirmed; or
- the confirmation of payment of a deposit on your order.
For existing orders, any variation to these Terms can only be made by written agreement between the Purchaser and the Company.
2Quotations and Pricing
- Unless previously amended or withdrawn, quotations are open for acceptance for 30 days from the date provided.
- All prices are shown in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. Clearance lot pricing may be quoted excluding GST where expressly noted.
- Prices do not include delivery unless expressly stated. Delivery charges are calculated at checkout.
- We reserve the right to correct pricing, product or availability errors, including after an order is placed. If a genuine error affects your order, we will contact you to confirm, amend or cancel the order and refund any amount paid in full.
3Orders and Order Confirmation
An order is not binding until the Company provides written acceptance or confirmation of the order, at our absolute discretion. We may decline or cancel an order, including where stock is unavailable, where a pricing error has occurred, or where we are unable to verify payment or delivery details.
Stock shown online is indicative only. Tiles are supplied in full boxes; order quantities may be rounded up to the nearest full box. We recommend allowing an appropriate wastage allowance (commonly 10–15%, and more for diagonal or patterned layouts) and ordering all material required for a project at the one time, as matching batches cannot be guaranteed on a later order.
4Product Images, Colour and Natural Variation
Tiles and natural stone are subject to batch variation. Shade, pattern, design, tone, texture, calibration and thickness may vary between batches and between the product supplied and any image, sample or display.
Photographs and swatches on this website are a guide only. Screen settings, lighting and photography affect how colour appears, and we cannot guarantee that on-screen colour accurately represents the product. Variation of this kind is inherent to the product, is outside the Company's control, and is not a fault or a defect.
5Samples
All sample orders are non-refundable. Refunds will not be provided for sample orders unless the wrong product has been dispatched by Design Tiles.
- Samples are not full-size tiles and are provided as an indication of the product only. They are subject to batch variation in shade, pattern, design, tone and texture.
- Sample processing may take up to 3–5 business days. Delivery of samples typically takes a further 1–5 business days depending on location.
- Click and Collect samples: Design Tiles will hold a sample order for up to 14 days. If the order is not collected within this period, a refund cannot be provided.
6Payment
Online orders are payable in full at checkout unless we agree otherwise in writing.
Where payment by deposit has been agreed (including in-store, special order and indent orders), and subject to any terms agreed in writing between the Company and the Purchaser, the terms of payment are:
- a 50% deposit is required upon placement of the order;
- a further 25% of the balance is due 4 weeks from the date of the order; and
- the final 25% balance must be settled within 6 weeks from the order placement.
Goods will not be released or dispatched until payment has cleared in full.
7Order Hold and Storage Fees
We ask that customers collect or accept delivery of their orders within 4–6 weeks from the order date. If an order is not collected within this period, a storage fee of $20 per pallet per week applies for any remaining held goods beyond the initial 4–6 week timeframe.
8Warehouse Pickup (Click and Collect)
NSW customers may select warehouse pickup at checkout.
Pickup location: 407 Princes Highway, Rockdale NSW 2216, during business hours.
Please wait for confirmation that your order is ready before attending. Tiles are heavy: it is the Purchaser's responsibility to confirm their vehicle's load capacity against our Vehicle Load Guide before collection, and to secure and restrain the load. We may decline to load a vehicle where doing so would be unsafe or exceed the vehicle's rated capacity.
9Delivery of Goods
We will use reasonable efforts to deliver the goods by the date and to the place specified by the Purchaser. However:
- The Company is not liable for late delivery or delay in delivery, and a delay does not entitle the Purchaser to cancel an order or terminate these Terms.
- The Company is not liable for any failure to provide goods due to transportation or shipping delays, supplier delays, or any other circumstances beyond our reasonable control.
- Orders must be confirmed with payment or deposit at least 72 hours before a scheduled delivery booking.
- Delivery timeframes are estimates only. Interstate deliveries typically take up to 12 business days depending on location.
- Fuel surcharges and distance-based surcharges may apply and will be confirmed by the transport company at the time of order.
NSW Metropolitan deliveries
- Hand unloading is only available for small orders of fewer than 5 boxes where each box weighs under 25 kg.
- Orders exceeding this limit are delivered kerbside only via Hiab (crane).
- Skid and pallet deliveries are made kerbside only, using a Hiab (crane).
Non-metropolitan NSW, interstate and regional
- Deliveries are made using third-party freight providers. Most use Hiab, forklift or tail-lift equipment and deliver kerbside only.
- It is the customer's responsibility to ensure the delivery location is safely and legally accessible for kerbside unloading, including sufficient clearance, access and a person over 18 present to receive the goods.
Access, redirection and failed delivery
- A fee of $150 applies where an incorrect address is supplied, where the site is inaccessible, or where a delivery must be redirected or re-attempted.
- If the Purchaser fails to take delivery of goods pursuant to an order, the Company reserves the right to charge a restocking fee of 25% of the value of that order. This amount is a reasonable pre-estimate of the loss the Company will incur in those circumstances.
10Third-Party Couriers and Risk
The Company is not responsible for the goods once they are collected from the warehouse, whether by a third-party courier engaged by the Purchaser or by the Purchaser themselves. We do not endorse third-party courier services and take no responsibility for late delivery or goods damaged in transit where a courier is arranged by the Purchaser. It is the Purchaser's responsibility to arrange appropriate insurance in those circumstances.
11Title and Retention of Goods
Until full payment for the goods is received:
- title in the goods remains with the Company;
- the Purchaser acknowledges that the Company retains the right to enter any premises owned, occupied or used for storage by the Purchaser and reclaim the goods at any time; and
- any marketing merchandise provided to the customer at no cost remains the property of Design Tiles at all times.
12Inspection, Shortages and Damage
In the event of any shortage, damage or breakage, the Purchaser must notify us in writing, with photographs of the damaged product and packaging, within 48 hours of delivery.
- It is the responsibility of the Purchaser to check the quality and quantity of the products supplied upon delivery or pickup.
- Claims cannot be recognised after the goods have been installed. Tiles should be inspected and dry-laid before installation. Installation constitutes acceptance of the goods as supplied.
- Please direct claims to admin@designtiles.com.au or accounts@designtiles.com.au.
13Cancellations and Handling Fees
- If you cancel your order before it has been dispatched or received from our supplier, no handling fee is charged and you will receive a full refund.
- If an order (placed online or in-store) is cancelled after we have received the stock from our supplier, a 20% handling fee applies to cover restocking and processing costs.
- Customers will be notified of the status of their order at the time of the cancellation request.
- Cancellations and exchanges are not accepted for special or indent orders, or for natural stone and natural marble orders.
14Returns and Refunds
These conditions apply in addition to, and do not limit, your rights under the Australian Consumer Law (see clause 17).
- Requests for returns must be made in writing within 7–14 days of the invoice date, and are subject to the supplier confirming the goods are of the same batch and tone.
- A 25% handling fee based on the purchase price applies to accepted returns.
- All goods must be returned within 14 days, directly to the supplier's warehouse, at the Purchaser's cost.
- Returned items will only be accepted in the same condition as received, in unopened boxes.
- Returns of less than 3m² will not be accepted.
- Returns are not accepted on discontinued lines, sale items, clearance items, or commercial quality products.
- Lighting: no refunds or returns are offered on any lighting products purchased.
- Samples: non-refundable, as set out in clause 5.
- Approved refunds are paid within 30 days of confirmation of the refund, by Electronic Funds Transfer (EFT) only.
15Clearance, Ex-Display and Second-Quality Goods
Clearance, sale, floor-stock, ex-display, discontinued, end-of-run and second-quality items are sold as-is.
- There are no refunds, credits, exchanges or returns for change of mind, over-ordering or incorrect selection.
- The clearance price is the final price. No further trade, wholesale, volume, sample or promotional discount applies, and clearance pricing is not combinable with any other offer.
- Sold while stocks last. Items are offered only in the quantity we physically hold. Stock is not reserved, held or back-ordered, and matching batches or tones cannot be guaranteed or re-supplied.
- Ex-display and floor-stock items are one-off and sold as-is. They are not warranted to be first quality and may show mild wear, chips or other minor imperfections, so please inspect before you buy.
- Where stated, clearance lot prices are ex GST and reflect the total remaining stock at the time of publication.
16Installation and Maintenance
The Company provides no guarantee or advice regarding installation, fixing, grouting or maintenance of tiles. It is the responsibility of the Purchaser to engage an experienced, licensed tiler, and the Company is not responsible for the materials once installed.
Acidic, caustic or detergent cleaners should not be used on stone, as they may damage the surface. pH-neutral cleaners are recommended. Natural stone may require sealing prior to and after installation.
Unless specifically confirmed in writing by the Company, no tiles are guaranteed against chipping, crazing or wear.
17Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
18Limitation of Liability
Subject to clause 17, all express or implied representations, conditions, statutory guarantees, warranties and provisions relating to these Terms that are not contained in them are excluded to the fullest extent permitted by law.
To the extent permitted by law, the Company will not be liable for any special, indirect, consequential or economic loss, damage, or loss of profits suffered by the Purchaser or any other person resulting from any act or omission by the Company, including breach, termination or non-observance of the terms of an order or agreement incorporating these Terms. Where liability cannot be excluded, our liability is limited, at our option, to the replacement of the goods, the supply of equivalent goods, or the payment of the cost of doing so.
19Website Use and Intellectual Property

20Promotions and Discount Codes
Promotional offers and discount codes are subject to their own stated conditions, cannot be used in conjunction with any other offer unless expressly stated, are not redeemable for cash, and may be withdrawn or amended at any time. Discount codes do not apply to clearance, sale or trade-priced goods.
21Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these Terms. Please see our Privacy Policy for details.
22Events Beyond Our Control
The Company is not liable for any delay in, or failure of, performance caused by circumstances beyond its reasonable control, including acts of God, fire, flood, storm, pandemic, industrial action, transport failure, shipping delays, supplier failure, or government restriction.
